Summary
A man delivered legal papers to a house when a Rottweiler attacked him. The dog owner was aggravated by the victim’s presence on his property and sent his dog after him. The dog charged at the man and attacked him causing many injuries.
The Dog Attack
On May 14, 2014, the victim went to serve legal documents to the defendant’s house. He had walked up onto the porch when the dog owner started swearing at him. The owner then opened his front door, allowing his Rottweiler-type dog out and instructing it to attack. The man tried to escape but fell down the porch stairs and hit his head on his truck and landed on his hand with full force on a stone surface. The dog then latched onto his ankle and didn’t let go until the dog owner called him off. The victim got into his truck quickly and drove to the hospital with his hands bleeding.
Victim injuries from a Dog attack
As a result of the dog attack, the victim suffered a bruised left hip which resolved in a couple of weeks, and a scraped left knee which was cleaned up at the hospital and bandaged.
His hands were his most severe injuries. Both were lacerated, the left one deep enough to expose tendon and bone. He received 4 stitches on the right hand and 12 on the left. A few days later he developed an infection in his left hand and had to return to the hospital.He was left with permanent scarring.
Due to the damage to his hands, he could no longer take care of his 12 and 15-year-old children and had to hire a PSW to help do his parenting tasks like driving and cooking for the next 3 months.
Compensation for victim
The victim filed a lawsuit against the dog’s owner, seeking damages for his injuries. The court found in favour of the victim and ordered the dog’s owner to pay him $38,780 in damages.
