The car accident

A woman was involved in a car accident in the city of Burlington Ontario on December 3rd, 1999. She was stopped at a red light when she was rear-ended by another car.

She suffered soft tissue injuries to her neck, shoulder, upper and lower back, and hip. She also suffered damage to her inner ear which caused hearing loss. The loss of hearing was moderate but permanent and has caused her balance problems. The pain from her injuries continues to persist and is likely to never fully resolve and this prognosis has caused her periods of depression.  

Compensation 

The judge concluded that since her injuries are permanent and seriously affect her functioning that she can pursue damages. She received $125 000 for general damages, $119,471 for loss of past income, and $250,000 for loss of future income.
