According to reports, the woman was walking through the store when she slipped on a piece of lettuce and fell. As a result of the fall, she suffered injuries to her right shoulder and left leg.
The Slip and Fall incident
On May 12, 2007, the victim was shopping at a Costco store with her daughter when she slipped on a piece of lettuce that had fallen on the floor. She had fallen in such a way that her left leg got caught underneath her. She was there with her daughter who then brought her home since she was in a lot of pain.
Injuries from the Slip and Fall
Prior to the accident she was an active woman and used a treadmill to maintain her health. She now has significant pain in her left knee and requires a knee brace to walk or stand. She also suffers from pain in her neck and shoulder, so she sees a massage therapist to prevent her shoulder from locking up. Often times she experiences headaches and back pain because of the injuries she sustained in the fall.
Costco’s liability for the accident
Costco has a policy where employees perform floor checks constantly but mainly near their flower displays and the bathrooms. The judge found that the scheduled inspection of the building/floors was inadequate. The aisle in which the woman fell had no regularly scheduled inspection. The lettuce ended up on the floor due to a salad display. It was foreseeable that customers would carry the salads and potentially drop some. The area around the display should have had scheduled inspections. The judge found that Costco’s failure to complete floor inspection was negligent and they were found liable for the woman’s injuries.
Compensation for victim’s injuries
The court awarded her $30,000 in general damages $8,000 for past expenses and $10,000 for future care.
